Belarusian Parliament Introduced Amendments into Law “On Customs Tariff”

The bill containing amendments and additions to the law “On Customs Tariffs” was adopted at the second reading by the House of Representatives of Belarusian National Assembly.

Submitting the bill to the parliament Alexander Gudkov, member of the Standing Committee for International Affairs and Contacts with the CIS, explained that its development was caused by the necessity to establish the order of application of the system used to calculate the customs value of goods imported to Belarus.

On a par with the existing list of extras and expenses which are either included or not included into the customs value of goods, the bill secures the possibility and mechanism of discounts when calculating customs value.

Calculating customs value according to the price of a bargain for identical goods, a declarer has no right to use previously approved customs value if customs authority documents that such value was applied wrong. Thus, the burden of proof is shifted from a declarer onto the customs authority.

Besides that, the bill empowers State Customs Committee to establish special order so as to control the correctness of calculation of certain goods’ customs value yet exclusively in order to simplify and cut the time of customs clearance. An economic player has the right to choose either common or simplified order of customs clearance and control of imported goods.

Moreover, the bill gives an opportunity to correct customs value of previously cleared goods if unreliable data is revealed either by the customs authority or an economic player himself. This right will enable a declarer to correct customs value in case terms of transaction have been changed as well as to adjust declared information in accordance with accounting data.

Alexander Shpilevskiy, Chairman of Belarusian State Customs Committee, noted in his day: “The adoption of the bill will let us make the order of application of the system used to calculate the customs value of goods imported to Belarus more concrete as well as cut the time of customs clearance and control”. According to him, the amendments introduced presuppose the use of the mechanism of discounts when calculating customs value which completely conforms to the principles of the World Trade Organisation.
